This Refund & Cancellation Policy applies to all services provided by Shineing Digital LLP — website development, mobile application development, custom software, AI and cloud engineering, UI/UX and branding, digital marketing, maintenance and support, and any other engagement quoted by us.
It forms part of our Terms & Conditions and should be read alongside them. Where a signed contract, statement of work or proposal states different commercial terms for a specific project, that document prevails over this page for that project.
By making any payment to Shineing Digital LLP, you confirm that you have read and accepted this policy.
Standard milestone schedule
70% advance payment is required before any project work begins.
30% final payment is due before delivery, production deployment, source-code transfer, or handover of domain and server ownership.
- No design or development work starts until the advance payment has cleared in our bank account.
- Larger engagements may be split into additional milestones, each defined in the proposal or statement of work.
- Work outside the agreed scope — extra features, additional revision rounds, new third-party integrations or change requests — is quoted and invoiced separately.
- Late payment may result in development being paused until outstanding dues are cleared. Time lost to a payment pause is added to the delivery timeline.
We will consider a refund of the unused portion of a payment in the following circumstances:
- Before work begins — you cancel in writing after paying the advance but before project planning, discovery, wireframing, design or development has started. We refund the advance less any transaction charges already incurred.
- We cannot deliver — Shineing Digital LLP is unable to deliver the agreed scope for a reason within our control, and we cannot agree a revised scope or timeline with you. We refund the amount paid for the undelivered portion.
- Duplicate or incorrect payment — you are charged twice, or charged an incorrect amount, through a demonstrable error. We refund the excess in full.
- Service never commenced — a recurring service you paid for was never activated from our side.
Any refund approved outside these circumstances remains at the sole discretion of Shineing Digital LLP management, decided case by case.
Once work has started, the advance is non-refundable
When a project begins we allocate senior engineers and designers to it and turn down other work for that window. That booked capacity cannot be recovered, so advance payments are strictly non-refundable once planning, discovery, design, wireframing or development has commenced.
The following are not refundable under any circumstances:
- Work already completed — every milestone delivered or in progress up to the cancellation date remains payable in full.
- Third-party costs paid on your behalf — domain registration, web hosting, cloud infrastructure, SSL certificates, software licences, API and SaaS subscriptions, app store fees, stock assets and plugin purchases. These are paid to external vendors under their own terms and cannot be recovered by us.
- Advertising spend — budgets committed to Google Ads, Meta Ads or any other ad platform, once spent.
- Change of mind — a decision to change direction, platform, vendor or business plan after work has begun.
- Delays caused by you — a project stalled because content, approvals, access credentials or feedback were not provided.
- Termination for policy violation — where we end an engagement because of illegal activity, misrepresentation, or a breach of the prohibited-projects policy in our Terms & Conditions, all payments received are retained.
- Subjective dissatisfaction with design where the delivered work matches the approved scope, wireframes and revision rounds set out in the proposal.
Either party may terminate an engagement by giving official written notice to the other. Notice by email to the project contact is sufficient.
If you cancel
- The advance payment is not refunded once work has started.
- All completed work and milestones up to the cancellation date remain payable.
- Completed designs, source code, databases, graphics and project assets remain the exclusive property of Shineing Digital LLP until every outstanding payment is cleared. On full payment, ownership transfers to you as set out in our Terms & Conditions.
If we cancel
- Where we end an engagement for a reason within our control, you are refunded for the undelivered portion and receive the work completed to that point.
- Where we end an engagement because of a policy violation, illegal or fraudulent activity, or a legal risk, services stop immediately and payments received are retained.
Monthly and annual services — maintenance plans, AMC, hosting management, SEO and digital marketing retainers — run for the period you have paid for.
- Cancel at least 15 days before the next renewal date to stop the following cycle. Email is sufficient.
- The current billing period is not refunded on a part-used basis; the service remains available to you until that period ends.
- Marketing retainers are billed for the strategy, management and execution time delivered, which is separate from the ad spend passed through to the platform.
Send a written request to namaste@shineing.digital with "Refund Request" in the subject line, and include:
- Your name, company name and registered contact number.
- The project name, proposal or invoice number.
- The payment date, amount and transaction reference.
- The reason for the request, with any supporting detail.
What happens next
We acknowledge every request within 48 hours and complete our review within 7 business days. If a refund is approved, it is processed within 10 business days to the original payment method. Your bank or card issuer may take a further 5 to 10 business days to credit it. Transaction, gateway and currency-conversion charges are deducted from the refunded amount.
Please raise any concern with us directly before contacting your bank or card issuer. We would much rather resolve it with you.
Initiating a chargeback or payment dispute without first raising a written refund request with us is treated as a breach of our Terms & Conditions. In that event we reserve the right to suspend all work immediately, withhold delivery, revoke access to systems and assets we manage, and recover the disputed sum together with any associated costs.
This policy is governed by the laws of India. Any dispute arising out of or relating to it is subject to the exclusive jurisdiction of the competent courts at Kota, Rajasthan.
We may update this policy at any time. The Effective Date at the top of this page reflects the current version, and the version in force when your project was quoted applies to that project.
